In these terms we address you informally (“du” in German) – just as we do in class. This does not change their legal validity.
Part A – General provisions
§ 1 Scope
(1) These General Terms and Conditions apply to all contracts between you and ArabVista UG (haftungsbeschränkt) (“ArabVista”, “we”) for private lessons, group courses, courses for companies, public authorities and institutions, study trips, intensive courses abroad and the purchase of books and learning materials.
(2) A consumer is any natural person who concludes a contract predominantly for private purposes (Section 13 German Civil Code, BGB). An entrepreneur is anyone who, when concluding the contract, acts in the exercise of their commercial or independent professional activity (Section 14 BGB).
(3) Deviating terms only apply if we expressly agree to them in text form.
§ 2 Conclusion of contract
(1) Our offers on the website do not yet constitute a binding offer. By clicking the order or booking button you submit a binding offer. The contract is concluded as soon as we confirm your booking by email.
(2) You can also book by email. In this case, too, the contract is concluded with our confirmation.
(3) The language of the contract is German. We store the contract text; with the booking confirmation you receive these terms and the cancellation policy by email.
§ 3 Your account
(1) With your first booking we automatically create an account for you. You receive the link to set your password by email. In your account you see your dates, your material and your invoices, manage your subscription and can refer friends (§ 29).
(2) Please keep your login details secret. Your account is personal and not transferable.
§ 4 Prices and payment
(1) The prices shown on the website at the time of your booking apply. All prices are final prices. Our language courses are exempt from VAT under Section 4 No. 21 German VAT Act (UStG); for books and other services the statutory VAT is included in the price.
(2) You pay using the payment methods we offer when booking (e.g. SEPA direct debit or card). Subscriptions are charged monthly in advance, on the first day of your subscription month.
(3) If a direct debit bounces for a reason you are responsible for, you bear the resulting bank charges.
(4) If you are in arrears with a payment, we may suspend lessons until the payment has been received.
§ 5 Right of withdrawal
(1) As a consumer you have a statutory 14-day right of withdrawal for contracts concluded online, by email or by phone. You can find all details and the model withdrawal form in our cancellation policy.
(2) If your lessons or course are to begin before the 14 days have expired, you expressly confirm this when booking. If you withdraw afterwards, you pay the share for the lessons that have already taken place up to your withdrawal. Lessons already given are therefore always paid for; only the rest is refunded.
(3) The cancellation and termination rules in these terms apply in addition. They do not restrict your statutory right of withdrawal.
Part B – Private lessons (online)
§ 6 Plans
(1) There are two types of plan:
Subscription – fixed lessons every week, cancellable monthly (§§ 7 and 8):
- 1 lesson per week (4 lessons per subscription month)
- 2 lessons per week (8 lessons per subscription month)
- Individual: 3 to 10 lessons per week
Package of lessons – any number of lessons you choose, without fixed weekly lessons. The more lessons you book, the cheaper each lesson (the package price depends on the number of lessons; a package comprises at most 15 lessons). A lesson package is valid for 6 months from purchase; lessons not taken by then expire.
(2) Current prices are shown on the page Private lessons. For the Syrian and Egyptian dialects each lesson costs €5 more than for Standard Arabic. If you would like to study more than 10 lessons per week, for example for an intensive course, write to us – we will make you an individual offer.
(3) If two people learn together in the same lessons, each person receives 25% off their plan. Each person books and pays separately through their own account; you link your accounts with a partner code. The shared dates are only confirmed once both have paid. If one person cancels or pauses, the other can continue alone at the normal price from the next subscription month or cancel as well.
(4) A lesson lasts 45 minutes. Lessons take place live online via video call.
§ 7 Term, subscription month and cancellation
(1) Your subscription starts on the day you book. A subscription month runs from that day until the day before the same calendar day in the next month (example: booking on 25.03. – subscription month from 25.03. to 24.04.).
(2) Your subscription automatically renews for one subscription month at a time unless you cancel it.
(3) You can cancel at any time to the end of the current subscription month – in your account, via the button “Verträge hier kündigen” (cancel contracts here) on our website or by email. There is no longer notice period. You can still take your remaining lessons until the end of the subscription month; after that nothing more is charged.
Example: you book on 25.03. and cancel on 20.06. Your lessons continue up to and including 24.06., then the subscription ends.
(4) We can also cancel the subscription to the end of a subscription month. The right to extraordinary termination for good cause remains for both sides.
§ 8 Pausing and changing plan
(1) You can pause your subscription in your account – as often as you like. The pause begins at the end of the current subscription month. During the pause there are no lessons and nothing is charged.
(2) You can reactivate your subscription at any time in your account. A new subscription month begins on the day of reactivation.
(3) You can change your plan in your account at any time. If you switch to a larger plan (e.g. from 1 to 2 lessons per week), it applies immediately: your remaining credit from the current subscription month is counted, you only pay the pro-rata difference until the end of the subscription month and the full new price from the next subscription month. If you switch to a smaller plan, it applies from the next subscription month.
§ 9 Scheduling lessons
(1) You book your lessons yourself in your account, from your teacher’s available times. With a subscription you have as many lessons per week as your plan provides.
(2) With a subscription, lessons you do not schedule in a week expire; they are neither refunded nor carried over, and your subscription price stays the same. With a lesson package you schedule freely within the 6 months.
§ 10 Cancellation, lateness and no-shows
(1) You can cancel a lesson free of charge in your account up to 24 hours before it starts. You can then book a replacement lesson – with a subscription in the same week, with a lesson package at any time within the validity period – provided your teacher still has free times.
(2) If you cancel later than 24 hours before the start or do not show up, the lesson counts as taken.
(3) Lessons start and end on time. If you are not there 15 minutes after the start without letting us know, the lesson counts as taken.
(4) If your teacher has to cancel or reschedule a lesson, you automatically receive a message with the reason and can book a replacement lesson. In this case the lesson does not expire.
(5) If your teacher is absent for a longer period or changes, we will endeavour to find a new teacher within 4 weeks. If this is not possible, we refund the paid lessons not yet taken.
§ 11 Free trial lesson
The free trial lesson (two teaching units, once per course) is non-binding. A subscription or course booking only comes about when you book. The trial lesson is free if you do not take part afterwards; if you book the course, the full course price applies – the trial lesson is not credited and does not entitle you to a discount.
Part C – Group courses (online)
§ 12 Course offer
(1) Dates, level, number of sessions and price are stated in the respective course description on the website.
(2) A group course takes place with four or more participants.
§ 13 Cancellation by you
(1) You can cancel your booking free of charge up to 7 days before the first session, in your account or by email. After that the booking is binding and the full course fee is due.
(2) Cancellation is no longer possible after the course has started. If you are unsure whether a course suits you, take part in a free trial lesson beforehand.
(3) Group sessions cannot be rescheduled individually. Missed sessions are not made up or refunded in the group course. As a group course participant, however, you can make up a missed group session as a private lesson – at the reduced price of €23. One private lesson (45 minutes) corresponds to a whole group session (two teaching units of 45 minutes each); so one private lesson is sufficient per missed session.
(4) Your statutory right of withdrawal (§ 5) remains unaffected.
§ 14 Cancellation and rescheduling by ArabVista
(1) If a session has to be cancelled, for example because the teacher is ill, it will be made up: the course is extended by that session and all following sessions are moved accordingly. You can always see the current dates in your account and on the website; we inform you of changes by email.
(2) If not enough participants sign up or we have to cancel a course for other reasons, you can choose: another course, a switch to private lessons (the course fee paid is credited) or a full refund.
Part D – Courses for companies, public authorities and institutions
§ 15 Contracting party and service
(1) The contract is concluded between ArabVista and the client (company, public authority, public body or other institution).
(2) Content, duration, teaching format and scope result from the individual offer and the training contract. ArabVista’s corporate contract applies in addition.
§ 16 Cancellation
- Up to 14 days before the course starts: free of charge
- 7 to 13 days before the course starts: 50% of the fee
- Less than 7 days before the course starts or after it has started: 100% of the fee
- Participants can be changed free of charge until the course starts.
§ 17 Delivery, remuneration and certificates
(1) If a teacher is absent, we provide a substitute or reschedule the teaching unit in agreement with the client.
(2) The invoice goes to the client. Payment due: 14 days after the invoice date.
(3) After completion, participants receive a certificate of attendance with content, scope and period.
Part E – Study trips
For our study trips we distinguish between two separate services: the Trip programme, which we organise ourselves (§§ 18–20), and the optional booking service for flights and hotels, for which we act only as an intermediary (§ 21).
§ 18 Trip programme and registration
(1) The trip programme comprises the on-site services stated in the trip description, e.g. tour guide, excursions, transfers, entrance fees and meals. Flights and accommodation are not included. Where applicable, the statutory provisions on package travel (Sections 651a et seq. BGB) apply to the trip programme.
(2) You register online or by email and pay a binding registration fee of €250. It secures your place and is credited towards the programme price.
§ 19 Minimum number of participants, confirmation and final payment
(1) The trip takes place with 6 or more participants. As soon as this number is reached, we confirm the trip and send you the insolvency protection certificate and the invoice for the remaining programme price with the due date.
(2) Your payments are protected against insolvency of ArabVista (surety insurance with R+V Allgemeine Versicherung AG, Raiffeisenplatz 1, 65189 Wiesbaden, Germany).
(3) If the minimum number of participants is not reached 6 weeks before departure, we cancel the trip and refund all payments for the trip programme without undue delay, at the latest within 14 days.
(4) If you do not pay the balance by the due date, we may reallocate your place after an unsuccessful reminder. In this case the registration fee is retained as compensation.
§ 20 Delivery, dates and cancellation of the programme
(1) The content differs depending on the programme chosen (language or culture trip). Minor changes to individual programme items (e.g. due to weather or the closure of a sight) are possible as long as the character of the trip is preserved.
(2) If we book flights and hotels for you via the booking service (§ 21), your arrival and departure may shift by one to two days due to the airlines‘ flight schedules. We will inform you of this in good time.
(3) We will tell you the meeting point in good time. Please be there on time; missed programme items are not refunded.
(4) If we have to cancel the programme due to unavoidable, extraordinary circumstances (e.g. war, unrest, natural disasters, official orders), we refund the programme price paid. § 21 applies to flights and hotels.
§ 21 Booking service for flights and hotels (intermediation)
(1) On request, after the trip has been confirmed, we book flights and hotels for you. For this we conclude a separate brokerage agreement with you, with its own offer and its own invoice. The service fee is €200 per person or €300 for two people in a double room, plus the actual costs of flights and hotel as per receipt and any extras you want (e.g. extra baggage, in-flight meals).
(2) In doing so we act only as an intermediary in your name. The contract of carriage is concluded directly between you and the airline, the accommodation contract directly between you and the hotel. Their terms apply. We are not the organiser of these services and are not liable for their performance, only for careful intermediation.
(3) If a flight is cancelled or a hotel cannot be used – including due to war, natural disasters or other force majeure – refunds and rebooking are governed by the terms of the airline or hotel and statutory air passenger rights. We support you with this and forward any refunds we receive to you without delay. You bear costs that the airline or hotel does not refund; we recommend travel cancellation insurance for this.
(4) The service fee is earned once the booking has been made and is not refunded. If you cancel flights or hotels, the cancellation terms of the respective providers apply.
§ 22 Withdrawal by you, substitute and defects
(1) Within 14 days of registering you can withdraw from the trip programme free of charge; we refund the registration fee.
(2) If you withdraw later, we retain the registration fee. If you have already paid the balance, we charge a flat-rate compensation of the programme price, but at least the registration fee:
- up to 90 days before departure: 20%
- 89 to 60 days before departure: 40%
- 59 to 30 days before departure: 60%
- 29 to 15 days before departure: 80%
- 14 days or less before departure or no-show: 90%
(3) You can prove to us at any time that we incurred no damage or significantly less damage. For flights and hotels arranged through us, the terms of the respective providers apply (§ 21).
(4) You can name a substitute up to 7 days before departure. Any additional costs incurred are borne by both of you jointly.
(5) If a defect in the programme becomes apparent during the trip, please tell our tour guide or us immediately so that we can remedy it.
(6) We recommend trip cancellation insurance, international travel health insurance and travel accident insurance.
Part F – Intensive course in Oman
§ 23 Service and partner school
(1) The intensive course in Oman is run by our partner school on site. We arrange your course place and the school’s accommodation and take care of advice, registration, placement, organisation and support (service package). The school’s rules, which we inform you about with the offer, also apply to lessons, accommodation, meals and excursions on site.
(2) Services, period and price result from your personal offer. Flights are not included; on request we book them for you (§ 26).
(3) The school decides which class you join after the placement test. We cannot guarantee a particular level or group size. Minor changes to lesson times, teachers, accommodation or excursions are reserved.
§ 24 Registration, prices and payment
(1) The contract is concluded when you accept our offer and make the deposit. Only once the deposit has been received do we register you with the school and secure your place.
(2) The deposit covers the price for course and accommodation as per the offer. The service fee as per the offer is earned upon registration with the school; we may invoice it with the final invoice. You pay outstanding amounts by the date stated in the offer or invoice, but no later than 21 days before the course starts.
(3) We give you fixed prices in euros in the offer. If the school changes its prices before we have registered you, we adjust the offer and you can decide whether to accept it.
(4) You pay separately for visa costs, single rooms, extensions, hotel nights outside the school accommodation, taxis and other extras, unless they are included in the offer.
§ 25 Cancellation, postponement and termination
(1) You can cancel free of charge up to 14 days before the course starts: we refund the amounts paid for course and accommodation. We no longer refund the service fee if we have already registered you with the school.
(2) If you cancel less than 14 days before the course starts, do not start the course or end it early, no refund for course and accommodation is possible.
(3) In the event of an emergency proven in writing (for example a serious illness or an emergency in your immediate family), we will ask the school for a partial refund or a postponement to a later course. The school may charge an administration fee for this (currently OMR 50).
(4) If you would like to postpone the date after full payment, we will look for a new date together with the school; the school’s administration fee may also apply here.
(5) Cancellations and postponements are only effective in text form (for example by email or via our contact form). Deadlines are counted in calendar days up to the first day of class.
§ 26 Travel documents, visa, flight and arrival
(1) You are responsible for valid travel documents, entry and visa; we and the school support you with this. Your passport must be valid for at least six months beyond the end of the course. If a visa applied for by the school on your behalf is refused, we refund the amounts for course and accommodation minus the school’s administration fee (currently OMR 50); the service fee remains payable.
(2) On request we book your flight. In doing so we act only as an intermediary; § 21 (2) to (4) apply accordingly. For the intensive course, the flight booking is included in the service fee. For the booking you pay a flight deposit; we then settle according to the actual ticket price and refund the difference or charge it additionally.
(3) The school picks you up at the airport as far as possible (currently on the day of arrival between 8 am and 8 pm). If you arrive outside these times, you bear the costs of a taxi or hotel yourself; we help you with planning.
§ 27 Rules on site, insurance and liability
(1) You comply with the school’s house rules and dress code as well as the laws and customs in Oman. If you miss class more than twice without an excuse or repeatedly break these rules, the school may exclude you from the course after a warning; no refund is then made.
(2) International travel health insurance is a requirement for participation. Costs for medical treatment or for flight changes due to illness are not included in the price. We also recommend travel cancellation insurance.
(3) If the school has to change course times or content for organisational reasons or due to force majeure, we will inform you immediately. If the course is cancelled, we will seek a full refund and forward to you without delay all amounts we receive back from the school.
(4) The school provides lessons, accommodation, meals and excursions under its own responsibility. We are liable for the careful selection of the school, correct intermediation and information and for our service package, but not for the performance of the school’s services. § 32 remains unaffected.
Part G – Books and learning materials
§ 28 Ordering and delivery
(1) Books are usually delivered to you directly by our publishing partner. For this purpose we pass on your name and delivery address to the publisher.
(2) The goods remain our property until paid for in full.
(3) The statutory right of withdrawal for goods (see cancellation policy) and statutory warranty for defects apply to books.
Part H – Refer a friend
§ 29 Refer a friend (referral programme)
(1) If you have an account and have already booked a course or study trip with us yourself, you can invite other people in your account under “Freunde werben” (refer a friend). An invitation is valid for 90 days. You can have up to 10 open invitations at the same time. You send the invitation message yourself; please only invite people who agree to this.
(2) The invited person receives a personal code worth €25 for their first booking. The code is only valid if they book with the email address the invitation was sent to, have not booked anything with us before and book courses or study trips worth more than €65. Books do not count, and there is no discount on books. The code can be redeemed once and is valid for 90 days.
(3) If the invited person books in this way within the 90 days, you receive a €50 voucher by email 14 days after their booking; you can also find it in your account. If the booking is cancelled, withdrawn or refunded by then to such an extent that its value is no longer above €65, there is no voucher.
(4) Your voucher is valid for 12 months and can be redeemed once – for courses, private lessons and study trips, not for books. It is linked to your account, not transferable and not paid out in cash. If your booking costs less than the voucher, the remainder expires.
(5) Anyone who invites themselves, uses several accounts or otherwise circumvents the programme does not receive a voucher; in this case we may block vouchers already issued.
(6) We may change or end the programme at any time with effect for the future. Vouchers you have received by then remain valid.
Part I – Final provisions
§ 30 Teaching material and recordings
Our teaching material is for your personal use only. Please do not pass it on and do not record lessons without the consent of everyone involved.
§ 31 Lessons only through ArabVista
Please do not arrange lessons directly with our teachers bypassing ArabVista. Our teachers are contractually obliged to offer lessons only through ArabVista.
§ 32 Liability
(1) We are liable without limitation for intent and gross negligence and for damage resulting from injury to life, body or health.
(2) In the event of slight negligence, we are only liable if we breach an essential contractual obligation, i.e. an obligation on whose fulfilment you may rely. Liability is then limited to the foreseeable, typical damage.
(3) We are not liable for third-party services that we only arrange (e.g. flights). Liability under mandatory statutory provisions remains unaffected.
§ 33 Dispute resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
§ 34 Applicable law and place of jurisdiction
(1) German law applies. If you are a consumer, this only applies insofar as you are not deprived of the protection of mandatory provisions of the country in which you live.
(2) If you are a merchant or a legal entity under public law, the place of jurisdiction is Berlin.
(3) If any provision of these terms is invalid, the remaining provisions remain valid.
